Summary Of The Warranty
Valid for contracts up to £30,000 (including VAT)
SECTION ONE – Deposit Protection
Payment protection for the amount of the deposit or advance payment, within limit set below, you have made to the retailer/supplier as a result of them:
· Ceasing to trade due to Liquidation, Receivership, Administration or the winding up of the business due to Bankruptcy, State Retirement or Death of the Principal(s).
Limit:
90 days protection from date of the first payment of the works.
The amount of deposit or advance payment up to 25% of the contract price increasing to 50% upon delivery of goods to your dwelling.
In either event, if a valid claim is submitted, we reserve the right to appoint another contractor to carry out the unfinished works.
Deposit protection ceases upon commencement of installation.
SECTION TWO – Work in Progress
Cover for the additional costs in completing the works in a manner equal to that provided in the specification of the works as a result of the contractor:
· Ceasing to trade as defined above
· Refusing to complete the works (only after IBSA arbitration has been exhausted)
Limit:
Failure to complete the Works applies after all the goods have been delivered to your dwelling and is limited to 30 days of the Estimated Completion Date and to a maximum of 50% of the installation price or advance payment made whichever is the lower.
SECTION THREE – Warranty Cover
Cover for the reasonable costs of rectifying any defects in the works, occurring within six years of date of completion of the works, carried out by the contractor resulting from defective workmanship commensurate with the terms of contract, in the event of the contractor/retailer:
· Ceasing to trade as defined above
· Refusing to rectify the defect (only after IBSA arbitration has been exhausted).
Limit:
100% of original contract price or £30,000 whichever is the lower
Warranty cover only applies if you have completed a signed satisfaction note.
EXCEPTIONS
1. The cost of routine maintenance, overhaul or modifications or loss or damage arising there from, any loss of use or consequential loss of any nature, any damage or defect caused by fair wear and tear, mould, rust, sunlight, heat, storm or deterioration due to neglect in maintenance.
2. The rectification of defective design of the works but not damage to the works resulting there from unless otherwise excluded.
3. Defects that do not inhibit the safe use of the works
4. Remedial work undertaken without the consent of the retailer
5. Discolouration of any kind.
6. Underfloor heating.
7. The first £150.00 of each and every claim.
CONDITIONS
1. Claims must be notified to the retailer within 30 days of discovery.
2. In the event of dispute/refusal with the retailer/contractor IBSA must be informed within three working days.
3. To rectify any defects attributable under this guarantee reasonable access times must be granted to the installers.
4. Valid claims must be submitted with actual receipts and/or plans.
